Terms of Use

1. Introduction and Scope

These Terms of Use govern your access to and use of:

• The ZoneMesh website and related webpages (the "Site"), and
• The ZoneMesh Hub software, including any containerized, agent-based, or bring-your-own-cloud ("BYOC") components that you deploy within your own infrastructure (the "Hub").

The Site and Hub are operated and provided by ZoneMesh, Inc. ("ZoneMesh," "we," "us," or "our").

By accessing the Site or deploying or operating the Hub, you agree to be bound by these Terms. If you do not agree, you must not use the Site or the Hub.

These Terms do not govern paid ZoneMesh services, enterprise subscriptions, or support offerings, which are subject to separate written agreements.

2. Architecture Acknowledgment (Important)

You acknowledge and agree that:

• The Hub runs entirely within infrastructure you own or control
• ZoneMesh does not host, operate, or control your Hub runtime environment
• ZoneMesh does not have access to your DNS zones, credentials, or infrastructure except as explicitly configured by you
• The Hub establishes an outbound connection to ZoneMesh-operated control plane services, which the control plane uses to manage, configure, orchestrate, monitor, license, and update the Hub

You are solely responsible for:

• Infrastructure security
• Network configuration
• Credential management
• Compliance obligations
• Data integrity and availability

3. Access to the Site and Hub

4. License to Use the Hub

Subject to these Terms, ZoneMesh grants you a limited, non-exclusive, non-transferable, revocable license to deploy and run the Hub solely for your internal business purposes in connection with ZoneMesh.

You may not:

• Reverse engineer or modify the Hub except as permitted by law
• Redistribute, sublicense, or resell the Hub
• Use the Hub to provide services to third parties without authorization
• Circumvent licensing, security, or usage controls

5. Customer Responsibilities for BYOC Deployment

You are solely responsible for:

• Securing the environment where the Hub runs
• Managing firewall rules, IAM policies, secrets, and certificates
• Ensuring DNS data accuracy and authorization
• Monitoring Hub performance and availability
• Applying operating system updates and security patches for the platform on which the Hub runs

ZoneMesh is not responsible for misconfiguration, infrastructure failures, data loss, or unauthorized access caused by customer actions or omissions.

6. Telemetry and Communications

The Hub may transmit operational metadata, health and status signals, and version or configuration identifiers to ZoneMesh control plane services.

This data is used solely to operate, secure, and improve ZoneMesh. No DNS query content or zone data is accessed unless explicitly configured by you.

7. Intellectual Property

All intellectual property rights in the Site and Hub remain with ZoneMesh or its licensors. No ownership rights are transferred under these Terms.

8. Disclaimers

THE SITE AND HUB ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZONEMESH DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND AVAILABILITY OR ERROR-FREE OPERATION.

ZoneMesh does not warrant that the Hub will operate in all environments or that customer configurations will be correct.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ZONEMESH OR ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, OR REPRESENTATIVES BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA, DNS RECORDS, CONFIGURATION, OR SERVICE INTERRUPTION, ARISING OUT OF OR RELATED TO THE USE OF THE SITE OR HUB.

Your sole remedy is to discontinue use.

10. Indemnification

You agree to defend, indemnify, and hold harmless ZoneMesh and its representatives from claims, damages, losses, or expenses arising from your deployment or operation of the Hub, your DNS configurations, or violations of law or third-party rights.

11. External Dependencies

The Hub may integrate with third-party cloud providers, DNS platforms, or networking services. ZoneMesh is not responsible for third-party outages, APIs, pricing changes, or service behavior.

ZoneMesh complies with the Digital Millennium Copyright Act (DMCA). Notices of alleged infringement should be sent to:

ZoneMesh may terminate or suspend access to the Site or Hub if you violate these Terms. Upon termination, your license to use the Hub ends and you must cease operation and uninstall it.

14. Governing Law
